Das Energie Private Limited is the owner and operator of all pages housed at dasenergie.com (the “Site”), as well as the resources, material, and services offered to users and other vendors. The following terms and conditions (referred to as the “Terms of Use,” or “TOU”) outline your responsibilities when you use the Site, its resources, content, and services, or any of the Services (as described in Section III, “Description of Services; Limitations on Services,”). Before proceeding, we advise you to read these TOUs. We also advise you to study Das Energie Private Limited’s Privacy Policy, which outlines how we meet our commitments to safeguard the privacy of our Users (see Section XI, “Privacy Policy,” below). In this TOU, “Das Energie Private Limited” and “Das Energie” are the same entity.
I. Acceptance of Terms
In the context of these Terms of Service, “you” and “User” refer to any user or visitor to the Site (as described in Section III, “Description of Services; Limitations on Services,” below). This definition also includes any Third-Party Vendors (as defined in Section III, below) and any employee of such vendors, whether acting on behalf of their employer or for their use.
By using the Site or the Services, you acknowledge that you have read, understood, and will comply with our TOU. Additionally, you agree to abide by these TOU and any applicable posted guidelines relating specifically to those resources or Services by using any of the resources or Services made available at the Site, whether by directly accessing the Site or such Services via alternative means (such as mobile number, email, mail, or facsimile transmission). Das Energie Private Limited retains the right, at any time and without prior notice to you, to change these TOU and any such rules. (See “Modifications to This Agreement,” Part II below.)
If you disagree with any term, condition, or guideline of the TOU, any guidelines, or any subsequent modification to either the TOU or any such guideline, your only option is to instantly stop visiting the Site and stop using the resources and Services offered. Das Energie Private Limited retains, but is not obligated to exercise, the right to strictly enforce the TOU and published rules, including but not limited to legal action and self-help, although it is not required to do so.
Before using this website or making use of any of the resources or services we offer, please carefully read these terms of use. By accepting these terms and conditions, you acknowledge that you are bound to the whole Terms of Service (TOU). You are not allowed to use this site or any of its resources or services if you do not accept all of its terms and conditions. Your agreement to all of the terms and conditions that make up the TOU, to the exclusion of all other terms, is expressly required before Das Energie Private Limited will allow your use of the Site and any linked resource or service. Das Energie Private Limited’s acceptance of the terms and conditions in the TOU is specifically restricted to these terms and conditions if they are deemed an offer.
II. Acceptance of Terms
The TOU may be changed, modified, or altered in any other way at any time without prior notice, at the sole discretion of Das Energie Private Limited. Any changes made here will take effect right away when they are posted. The Terms of Service (TOU) consist of an agreement between you and Das Energie Private Limited. It is your responsibility to periodically check the TOU and stay informed of any modifications to the agreement. The latest version of TOU can be viewed by clicking on the “Terms of Use ” link “Terms of Use” option present at the bottom of any page on the Site.
III. Description of Services; Limitations on Services
Das Energie Private Limited shall provide Content (as defined below) from time to time, together with certain resources and services, all as described more fully on the Site (the “Services”).
Services to you by Das Energie Private Limited may include, but not be limited to the following: estimators, calculators, dashboards, proposal solicitation platforms, graphical representations of financial and energy performance data, summaries, digests, self-evaluation guides (wizards), maps, member forums, and weblogs (blogs); information concerned with third-party vendors including, but not limited to, installers, manufacturers, installation partners, and other contractors, lenders and financial institutions (“Third-Party Vendors”); and service and product descriptions, including materials provided by Third-Party Vendors (whether such materials are delivered to you via the Site or through the Services, or delivered to you directly by a Third-Party Vendor in response to a Submitted Request, as defined in Section IV below, “Requests for Information and Services”).
Your acceptance of these materials, whether transmitted or displayed on the Site, or through the Services by means including, but not limited to, messages, text, user comments, data, information, graphics, brochures, articles, images, illustrations, photographs, video clips, audio clips, and software, (collectively, “Content”) is subject to these TOU. Das Energie Private Limited may change, discontinue or suspend the Services including any Content, at any time, for any reason. Das Energie may also place limitations on certain services and features or can restrict your access to parts of or all of the Services, without any liability or notice.
Anything provided herein shall not be construed as an offer or guarantee to deliver any goods or services, whether by Das Energie Private Limited or any Third-Party Vendor unless specifically expressed in writing on the Site or in Content about the Services. All products and services that are described on the Site or in Content related to such services may not be offered by Third-Party Vendors in all states or communities within a state. Additionally, the provision of specific products or services to Users may be contingent upon meeting qualifying requirements that are not set by Das Energie Private Limited and over which Das Energie Private Limited has no control, influence, or authority.
IV. Requests for Information and Services
You may extend an invitation to Das Energie Private Limited or any Third-Party Vendor to submit a request for information about goods and/or services, or a proposal to deliver goods and/or services. You agree that Das Energie Private Limited or a Third-Party Vendor, in response to any Submitted Request you submit, may use the Site, phone (if you include your phone number in your Submitted Request), email, mail, fax, or any other method to contact you with information and/or proposals.
If you include your phone number in your Submitted Request, it also serves as a formal request in writing for Das Energie Private Limited or any such Third-Party Vendor to call you, even if your number is on a state or federal Do Not Call registry maintained under state or federal law.
You will not be called, however, unless:
- You provide your mobile number as part of your Submitted Request, and
- Either you specifically request to be contacted by mobile phone or accept a Third Party Vendor’s proposal to deliver products and/or services to you.
V. Registration Requirements
To use and access certain Services, you need to register with Das Energie Private Limited and you must provide a valid email address to complete the registration process. Das Energie will generate a “screen name” for your account based on the email address provided by you when and if you register with us (a “Used ID”). You can change the Used ID generated by Das Energie at any time. Further, you are requested to provide complete accurate and up-to-date registration information with Das Energie. If you fail to provide registration information that meets our registration standards, that will be considered a breach of our TOU and your dasenergie.com account will be suspended immediately. In such cases, we can also terminate your account without any liability and prior notice.
You may not:
- Use or select the name of another person as a User ID with the intent of impersonating that person;
- Without proper authorisation, select or use any name subject to any rights belonging to a person other than yourself; or
- Create a User ID/User Name that is offensive, provocative, vulgar or obscene. In such cases, Das Energie Private Limited reserves the right in its sole discretion to refuse to register or cancel any User ID. You are solely responsible for maintaining the confidentiality of yourdasenergie.com User ID and password.
VI. User-Provided Content
Any content posted on, transmitted through, or linked from the Site by Registered Users, including but not limited to messages, text, files, images, photos, video, audio, data, or other materials, is the exclusive responsibility of the individual or Third-Party Vendor who created the User-Provided Content. Every piece of User-Provided Content that you email, post, or otherwise make available via the Site or the Services is solely your responsibility.
Das Energie is not responsible and does not control User-Provided Content made available via the Site or through the Services, and by using the Site and/or the Services, you acknowledge that you may be exposed to User-Provided Content that is inaccurate, incomplete, subjective or misleading. Additionally, User-Provided Content may contain links to other websites that are completely independent of Das Energie Private Limited. Das Energie makes no warranty or representation of the completeness, authenticity, or accuracy of the information presented or hosted by such sites.
It is solely your responsibility if you browse any other linked websites, or as part of User-Provided Content, that are not hosted by Das Energie. It must be done at your own risk and Das Energie is not liable for any incident that occurs with you for visiting sites that are part of User-Provided Content. Information (including Personal Information, as defined in Section XI, “Privacy Policy,” below) that is collected by third-party websites, whether or not such websites are linked as, or as part of, User-Provided Content, is governed by and subject to the privacy practices of those third-party websites and is not governed by or subject to Das Energie Private Limited’s Privacy Policy. You are encouraged to learn about the privacy policies and practices that pertain to or are published by, those third-party websites.
You acknowledge that there are risks involved with using user-provided content, that you should consider those risks before relying on user-provided content, and that Das Energie Private Limited will not be liable in any way for user-provided content or for any loss or damage resulting from using or relying on user-provided content that is posted, emailed, or otherwise made available via the Site or the Services. You understand that Das Energie Private Limited does not verify the veracity or completeness of user-provided content ahead of time and does not support any user-provided content, in whole or in part. Das Energie reserved the right, in its sole discretion, but is not obligated to move, delete or refuse to accept, any User-Provided Content that violates our the letter or the spirit of these TOU, or for any other reason.
Das Energie and its registered Users may express a variety of opinions on the Site or through the Services about distributed energy services and products as well as financial products and services. User-provided content contains statements and opinions made by registered users. Under no circumstances will Das Energie Private Limited be liable in any way for any User-Provided Content, including the opinions and statements of registered Users, or for any loss or damage of any kind incurred as a result of the use of, or reliance upon, User-Provided Content. Das Energie makes no claims regarding the veracity, accuracy, or completeness of opinions and other statements made by registered Users.
VII. Rights to User-Provided Content
When you submit User-Provided Content to Das Energie through the Site or the Services, you give Das Energie, its affiliates, representatives, and assigns the following license: non-exclusive, fully-paid, worldwide, transferable, royalty-free, with the right to grant sublicenses through several tiers of sublicensees; this license allows Das Energie to display, publicly perform, distribute, store, transcode, syndicate (including, without limitation, syndication through third-party websites), broadcast, transmit, reproduce, edit, modify, create derivative works and use and reuse your User-Provided Content (or any portion or derivative works) in any medium, in any manner, for any purpose. You understand and accept that you do not expect compensation or privacy about your user-provided content. Content submitted by users is accessible to all site users and services. Any User-Provided Content may be rejected, removed, or modified in Das Energie’s sole and absolute discretion.
By using the Site or the Services to submit User-Provided Content to Das Energie, you thereby represent and warrant that:
- You either already have all the rights in your User-Provided Content or you have obtained all the rights you need to grant Das Energie the rights in your User-Provided Content described herein;
- If your User-Provided Content is used or exploited for commercial purposes, you have paid and will continue to pay in full all licence fees, clearance fees, and other financial obligations;
- You are the person seen or heard in your User-Provided Content, or you have permission to grant the rights to Das Energie Private Limited outlined below from every person who appears and/or is heard in your User-Provided Content, including consent from parents or guardians for any person under the applicable age of majority;
- If any renewable or alternative energy system is featured or pictured in your User-Provided Content, it has been installed at your residence, place of business, or one of your properties; alternatively, if you are a Third Party Vendor, you have obtained the owner’s consent and can provide User-Provided Content related to the system;
- You agree to provide Das Energie Private Limited with access to all pertinent permissions regarding the User-Provided Content upon request;
- No third party’s intellectual property, privacy, publicity, or other legal or moral rights are violated by your user-provided content; and
- You acknowledge that Das Energie may access any records that you maintain in order to verify that the User-Provided Content you have provided does not breach any of the aforementioned representations and warranties. Das Energie Private Limited may request access to these records at any time.
VIII. Digital Millennium Copyright Act Compliance; Designated Agent
Das Energie Private Limited honours others’ rights to their intellectual property. Das Energie will take down any User-Provided Content that infringes copyright laws and ban the offending Users’ accounts after giving them due notice. Simply send us the information required if you feel that any Content maintained by Das Energie Private Limited violates your copyright and we will remove your copyrighted works from the Site and/or the Services.
IX. Third-Party Content and Websites; Third-Party Transactions and Services
The website may have features, content, and functionalities that connect you to or grant you access to data and materials supplied by third parties—including Third-Party Vendors—that are entirely unaffiliated with Das Energie Private Limited. Examples of such resources include, but are not limited to, directories, websites, servers, networks, systems, databases, apps, software, programs, goods, or services.
Das Energie is an online resource for home and business owners who are evaluating the costs and benefits of installing distributed energy systems in their homes and businesses. Das Energie Private Limited, among other things, gives those homeowners and business owners the chance to get in touch with third-party vendors, such as distributed energy system manufacturers, installers (such as electricians, plumbers, and other contractors), financiers (such as banks and other lending institutions), and so on, to obtain further information from them. This information may include project proposals, installation and other professional service estimates, and project financing. (See “Submitted Requests” in the previously mentioned Section IV, “Requests for Information and Services.”)
These distributed energy system manufacturers, distributors, and financiers may pay Das Energie Private Limited a fee or other remuneration in exchange for giving them the chance to reply to Submitted Requests (also known as “Opportunities”). Home and business owners are not charged by Das Energie Private Limited to use the Site or any of the Services. Furthermore, Das Energie Private Limited does not represent itself as a distributor, manufacturer, installer, contractor, broker, or installer of distributed energy systems. Das Energie Private Limited shall not be responsible or liable in any manner for any goods or services supplied by third parties, including Third-Party Vendors, or for any form of loss or damage resulting from the use of or reliance on such goods or services. Except for generating Opportunities in the way previously mentioned, Das Energie Private Limited is not authorised to act as an agent on behalf of any distributor of distributed energy systems, installers of distributed energy systems, other contractors, or financiers, and hereby expressly declines any such authority if offered.
Users can provide Das Energie Private Limited permission to serve as their agent or to offer consultancy services to them on a fee-for-service basis. Users shall not presume or infer that Das Energie Private Limited has agreed to provide consultancy services or operate as an agent on their behalf without express written consent. Users must give any such approval.
Das Energie does enter into partnerships from time to time with for-profit companies and firms, municipalities and other governmental entities, non-profit organisations, and employers (collectively “Channel Partners”), to offer their clients, members, customers, constituents, and employees the Services provided at the Site, as described in Section III, “Description of Services; Limitations on Services,” above.
Your dealings with organisations, firms, and/or individuals found on or through the Site or the Services, or with any Channel Partner with whom you are affiliated, including any payment(s) for the delivery of goods and/or services, and any other terms, conditions, warranties or representations associated with such dealings, whether or not you have authorised Das Energie in writing to serve as your agent on a fee-for-service basis, are solely between you and such organisations, firms, Channel Partners, and/or individuals. You should make whatever enquiry or investigation you feel is appropriate or necessary prior to engaging in any financial, transaction, or otherwise, with any of these third parties, including Third-Party Vendors and Channel Partners, whether or not you engage in any transaction, financial or otherwise, with any of these third parties, including upon the suggestion of Das Energie after authorising Das Energie in writing to provide you with consulting services or to act as your agent on your behalf on a fee for service basis.
By using the Site or the Services, or interacting with any Channel Partner, you acknowledge that Das Energie Private Limited will not be responsible or liable for any loss or damage of any kind that may arise from your dealings with businesses, organisations, Third-Party Vendors, and/or individuals. You acknowledge and agree that Das Energie Private Limited is not obligated to settle disputes or provide assistance in resolving disputes between you and other users of the site or services, third parties, including affiliated Channel Partners, or third-party vendors. You hereby release Das Energie, its officers, employees, agents, and successors in rights from claims, demands, and damages (actual and consequential) of any kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to disputes with one or more other Users of the Site or the Services, or any third party, including any Channel Partner with whom you are affiliated, or Third-Party Vendor.
X. Conduct
You ensure that you will use the Site or any of its Services for any unlawful purpose, that is otherwise not reasonably intended by Das Energie Private Limited or that is prohibited by these TOU. Neither may you use the Site nor any of the Services in any manner that could interfere with another party’s use and enjoyment of the Site or any of the Services.
You agree not to email, post, or otherwise make available Content:
- that is abusive, or intended to threaten or harass, impersonate or intimidate other Users;
- that is intended to obtain account, password, or Personal Information (as defined in Section XI, “Privacy Policy,” below) from any other User;
- that is defamatory, libellous or offensive, profane, or entirely unrelated to the purpose of the Site or the Services;
- that infringes the copyright, trademark, patent, trade secret, or other proprietary right of any User or other party; or
- that violates the legal rights (such as the right to privacy) of others.
Each of the following is provided as an example of, and not as a limitation on, prohibited conduct.
You acknowledge and agree that you will not use any other automated access to the Site or any of the Services for any purpose without Das Energie Private Limited’s prior written consent, except by using RSS feeds and other features that permit automated access to the Site or its Services.
You are strictly prohibited to use any information obtained from the Site or the Services to advertise, contact, solicitor to sell to any other User without the express written consent of such User having exclusively first been obtained using a Submitted Request. (See Section IV, “Requests for Information and Services,” above.)
You further agree that you shall not:
- use the Site or any service on behalf of, at the request of, or under the instruction of, any third party, or
- Transfer or sell your user ID or profile to another.
At any time, for any reason, including but not limited to the receipt of reports or claims from third parties, or legal or regulatory authorities, relating to such Content or User, Das Energie Private Limited retains the right, to be exercised in its sole discretion, to remove any Content and to deactivate any dasenergie.com User registration. For reporting TOU violations, send an email to connect@dasenergie.com. Your interactions with other Users of the Site and the Services, Channel Partners, and Third-Party Vendors are entirely at your own risk. When it comes to Content that you or that other User posts on the Site, or when it comes to materials that you both provide or distribute as part of the Services, Das Energie Private Limited has the right, but not the obligation, to monitor disputes between you and other Users.
XI. Privacy Policy
The types of information we may collect from you (including information that can be used to uniquely identify or contact a person, or “Personal Information”), how we may use it, how we store it and the steps we take to protect it, the situations in which we may disclose or transfer it, and the options you have regarding submitting and keeping the information you provide to us are all covered by Das Energie Private Limited’s privacy policy. We request you to read the Privacy Policy Page and to become familiar with our privacy practices. To read the latest Privacy Policy, click on the “Privacy Policy” link located at the bottom of each page on the Site.
XII. Copyright, Trademark and Service Mark Notices
All contents of the Site are Copyright © 2024 Das Energie Private Limited, and/or its Third-Party Vendors, all rights reserved. “Das Energie Private Limited” or “Das Energie” is a trademark of Das Energie Private Limited. The names of other professions and businesses, as well as other product and company names mentioned on the Site or in connection with the Services, may be trademarks of their respective owners.
Without the prior written consent of Das Energie Private Limited or the applicable Mark holder specifically for each such use, nothing on the Site or included in the Services should be interpreted as granting, by implication, estoppel, or otherwise, any licence or right to use any service mark or trademark (individually and collectively, “Mark” or “Marks”) displayed on the Site or as part of the Services. The Marks may not be used in any way that could harm the goodwill associated with them, nor may they be used to harm Das Energie Private Limited, the other professionals, the relevant third party, or their goods or services. It is prohibited to use any Mark as part of a link to or from any website unless Das Energie Private Limited has given written consent to such a link in advance.
Copyrighted material, trademarks, and other proprietary information are present on the Site and the Services. This includes but is not limited to, text, software, images, videos, graphics, music, and sound. Under Indian copyright laws, the entire contents of the Site and the Services are protected as a collective work. Both the original content and the content that has been chosen, organised, enhanced, and coordinated by Das Energie Private Limited are protected by copyright. You are not permitted to publish, modify, transmit, take part in the transfer or sale, make derivative works, or utilise any content—in whole or in part—in any other way. Except as otherwise expressly permitted under copyright law, no part of the downloaded material may be copied, redistributed, retransmitted, published, or used for any commercial or non-commercial purpose without the prior written consent of Das Energie Private Limited and the copyright owner. Trademarks, trade dress, unfair competition statutes, and other state and federal laws protect some elements of the site and services. As a result, they cannot be duplicated or imitated in whole or in part by any means, including, but not limited to, the use of framing or mirrors. Furthermore, there’s a chance that some of the Site’s and the Services’ resources are covered by pending or previously awarded patents.

Furthermore, Das Energie Private Limited reserves the right to modify and enhance the content given here at any time. Das Energie Private Limited shall not be responsible or liable for any loss or damage resulting from your use of information that you get from the Site or the Services. You must evaluate whether any information, advice, opinion, or other content made available through the Site or the Services is accurate, comprehensive, or useful.
The website, its services, and any related products, services, software, and information are offered “as is.” Regarding any subject matter relating to the Site and the services, and any information, software, products, and services provided therein, Das Energie Private Limited and/or its suppliers, providers, energy research professionals, or other professionals disclaim all warranties of any kind, whether express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. You bear all liability for using the Site and/or the services. Neither Das Energie Private Limited nor its suppliers, providers, energy research professionals, or other professionals shall be liable for any direct, indirect, punitive, incidental, special, consequential, or other damages or other injury arising out of or in any way connected with:
- usage of the Site and/or its services, inability to use it, delays in operation or transmission, or performance failure, whether or not brought on by communications failure, acts of God, theft, destruction, or unauthorised access to Das Energie Private Limited’s documents, programs, or services;
- any data/information, software, goods, and services acquired via the website or its services; this includes, but is not limited to, your reliance on any information found there; errors, defects, interruptions, deletion of files or emails, or other mistakes;
- worms, trojan horses, trap doors, viruses, or other computer programming routines or code that has the potential to contaminate or destroy something, or that is meant to harm, interfere negatively with, surreptitiously intercept, or expropriate any data, system, or personal information; or that
- else come from using the website or its services, whether fully or partially as a result of carelessness, tortious behaviour, or breach of contract. The aforementioned exclusion might not apply to you since some jurisdictions do not permit the exclusion of implied warranties.
XIV. Indemnity
You must release Das Energie Private Limited and its Third-Party Vendors from all liabilities, costs (including legal fees), and damages resulting from claims resulting from your use of the Site and/or the Services. This includes, without limitation, any claims alleging facts that, if true, would constitute a breach by you of this Agreement.
XV. Errors and Delays
Das Energie Private Limited is not responsible for any inaccuracies or delays in answering a request or referral form that result from factors outside of our reasonable control, such as incorrect email addresses you provide or other technical issues; additionally, we are not responsible for all liability for any inaccuracies or delays in answering requests or referral forms sent to third parties, including Third-Party Vendors.
XVI. Dispute Resolution
The arbitration shall be the exclusive and final means of resolving any dispute or claim arising from or related to the use of the Site or the Services, to any goods or services Das Energie Private Limited provides, or to any acts or omissions for which you may assert Das Energie Private Limited is liable, including but not limited to any dispute or claim regarding arbitrability (“Dispute”). The Indian Council Of Arbitration (“ICA”) current commercial arbitration rules will apply to the arbitration, which will be conducted before a single arbitrator. Das Energie will choose the arbitration’s venue and the location chosen will be fairly convenient to the company. The ICA rules will be followed in selecting the arbitrator. In the event that there is no ICA rule in place governing the choice of arbitrator, the consumer will choose an arbitrator from a panel Das Energie Private Limited accepts. Das Energie Private Limited shall bear the filing fee and the expenses of the first day of arbitration in any arbitration; the non-prevailing party shall bear the remaining arbitration costs; provided, however, that in Maine, any costs incurred by the consumer shall be restricted to the costs of launching a lawsuit. One of the parties must submit a written demand for arbitration in order to start the procedure.
Each party irrevocably waives any claim to damages in connection with any dispute over actual compensatory damages, and the arbitrators lack the authority to multiply actual damages or award consequential, punitive, or exemplary damages. The only exception to this is Maine, where state law will govern all rights and remedies in the arbitration. Regardless of the nature of the issues or conflicts involved, the agreement to arbitrate shall not be interpreted as consent to the joinder or consolidation of an arbitration under this agreement with an arbitration of disputes or claims of any non-party. No arbitration under this Agreement shall be joined to any other arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise, to the fullest extent permissible by applicable law.
This agreement stipulates that binding arbitration will be used to settle any disputes that may arise between you and Das Energie Private Limited. As a result, you forfeit your ability to defend or assert your legal rights in court. Additionally, you forfeit your ability to take part in or file a class action lawsuit. Instead of a jury or judge, impartial arbitrators will decide your rights.
The arbitration procedures are less complicated and more restrictive than the regulations that apply in a court, and you have the right to a fair trial. Arbitrator rulings are susceptible to very little court scrutiny and are enforceable like any other court order. You agree to these limitations by using the Site and the resources and services provided by Das Energie Private Limited. This is especially true should a dispute arise and the arbitration provisions herein become invalid or inapplicable. The winning party is entitled to reasonable attorneys’ costs if any party hires legal counsel to defend any rights in connection with a dispute or lawsuit.
XVII. Other Terms
This Agreement constitutes the entire agreement between you and Das Energie Private Limited and supersedes all prior or contemporaneous communications, promises, and proposals, whether oral, written, or electronic, between you and Das Energie Private Limited regarding the Site and the Services, and the information, software, products, and services associated with either of them. This Agreement (which hereby incorporates by reference any other provisions applicable to the use of the Site and the Services, including, but not limited to, any supplemental terms governing the use of certain specific material contained in the Site and the Services and any operating rules for the Site or the Services established by Das Energie Private Limited). The remainder of the Agreement will remain in force if any part of it is found to be invalid or unenforceable under applicable law, including but not limited to the liability limitations and warranty disclaimers stated above. In such a case, the invalid or unenforceable provision will be deemed superseded by a valid and enforceable provision that most closely matches the original provision’s intent. In judicial or administrative proceedings based on or relating to this Agreement, a printed copy of this Agreement and any electronic notice will be admissible to the same extent and subject to the same restrictions as other business documents and records originally generated and maintained in printed form. All rights reserved that are not specifically granted herein.
